{"id":353788,"date":"2023-01-28T08:53:54","date_gmt":"2023-01-28T11:53:54","guid":{"rendered":"https:\/\/www.planbnoticias.com.ar\/?p=353788"},"modified":"2023-01-28T08:53:54","modified_gmt":"2023-01-28T11:53:54","slug":"denuncian-al-gobierno-de-gerardo-morales-por-intimidacion-de-desalojo-a-comunidad-indigena","status":"publish","type":"post","link":"https:\/\/www.planbnoticias.com.ar\/index.php\/2023\/01\/28\/denuncian-al-gobierno-de-gerardo-morales-por-intimidacion-de-desalojo-a-comunidad-indigena\/","title":{"rendered":"Denuncian al gobierno de Gerardo Morales por intimidaci\u00f3n de desalojo a comunidad ind\u00edgena"},"content":{"rendered":"<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-353790\" src=\"https:\/\/www.planbnoticias.com.ar\/wp-content\/uploads\/2023\/01\/desalojo-jujuy2.jpg\" alt=\"\" width=\"667\" height=\"891\" srcset=\"https:\/\/www.planbnoticias.com.ar\/wp-content\/uploads\/2023\/01\/desalojo-jujuy2.jpg 667w, https:\/\/www.planbnoticias.com.ar\/wp-content\/uploads\/2023\/01\/desalojo-jujuy2-225x300.jpg 225w, https:\/\/www.planbnoticias.com.ar\/wp-content\/uploads\/2023\/01\/desalojo-jujuy2-585x781.jpg 585w\" sizes=\"(max-width: 667px) 100vw, 667px\" \/><\/p>\n<p>Mientras se desarrolla el Tinku (encuentro cultural) comunicaron el desalojo de la comunidad \u201cLas Capillas\u201d del pueblo Okloya.<\/p>\n<p>Durante el Tinku, comunicaron:<\/p>\n<p>URGENTE INTIMIDACION DE DESALOJO EN COMUNIDAD INDIGENA LAS CAPILLAS DEL PUEBLO OKLOYA<\/p>\n<p>ANTE EL TINKU \u201cENCUENTRO CULTURAL\u201d DE PUBLICO CONOCIMIENTO, QUE SE LLEVA ADELANTE TRADICIONALMENTE EN LAS DIFERENTES COMUNIDADES INDIGENAS INTEGRANTES DEL CONSEJO DE DELEGADOS DE COMUNIDADES ABORIGENES DEL PUEBLO OKLOYA \u2013 CDCAPO, PERSONERIA JURIDICA 1241 ReNOPI, VINCULADO A LA COSMOVISION Y ESPIRITUALIDAD; QUE SE DESARROLLARA EN EL DIA DE LA FECHA EN TERRITORIO COMUNITARIO DE LA MENCIONADA COMUNIDAD; COMO ASI YA LO HICIERON LAS COMUNIDADES INDIGENAS TIRAXI Y TESORERO.<\/p>\n<p><script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js\"><\/script><br \/>\n<!-- Publi m\u00f3vil interior nota --><br \/>\n<ins class=\"adsbygoogle\" style=\"display: inline-block; width: 320px; height: 100px;\" data-ad-client=\"ca-pub-7250018434179914\" data-ad-slot=\"1040343543\"><\/ins><br \/>\n<script>\n(adsbygoogle = window.adsbygoogle || []).push({});\n<\/script><\/p>\n<p>La notificaci\u00f3n llego ayer viernes 27 de enero a Hs. 19:47 de la comisaria seccional 23 Tel. 388-4270020 dependiente de la Unidad Regional 8 de Palpala, firmada por el oficial principal Ontiveros; cabe destacar que la Comunidad cuenta con Personer\u00eda Jur\u00eddica reconocida por la Secretaria de Pueblos Ind\u00edgenas de la Provincia de Jujuy y el ReNaCI; como as\u00ed tambi\u00e9n con carpeta t\u00e9cnica con resoluci\u00f3n en el marco de la ley 26160, donde el Estado Nacional y Provincial reconocen la posesi\u00f3n y ocupaci\u00f3n actual, tradicional y publica de la misma; resaltando que el Ministerio Publico de la Acusaci\u00f3n \u2013 MPA de la provincia de Jujuy a trav\u00e9s del fiscal general Dr. Enrique Lello Sanchez aprob\u00f3 el 30 de abril de 2021 el \u201cPROTOCOLO PARA EL ABORDAJE EN CONFLICTIVIDADES DE TIERRAS Y LAS COMUNIDADES ABORIGENES\u201d en el marco del Expte N\u00ba 11\/2021, considerando la necesidad de respetar la identidad cultural de los Pueblos Ind\u00edgenas, los derechos colectivos asumidos por el estado y especialmente la ley 26160, vigente por Decreto 805\/2021.<\/p>\n<p>En este aspecto se record\u00f3 a los fiscales de las causas en las que se investigan posibles hechos de usurpaci\u00f3n por parte de integrantes de comunidades abor\u00edgenes, que se encuentra en vigencia la ley que declara la emergencia en materia de posesi\u00f3n y `propiedad de las tierras que tradicionalmente ocupan las comunidades ind\u00edgenas originarias del pa\u00eds; de esta manera se pretende garantizar la manda constitucional de reconocer la posesi\u00f3n y propiedad comunitaria de las tierras que tradicionalmente ocupan las comunidades ind\u00edgenas preexistentes (art. 75 inc. 17 de la Constituci\u00f3n Nacional).<\/p>\n<p>POR LO QUE SE SOLICITA LA INTERVENCION DEL MINISTERIO DE DDHH Y PUEBLOS INDIGENAS DE LA PROVINCIA DE JUJY Y DEL INSTITUTO NACIONAL DE ASUNTOS INDIGENAS ORGANISMOS GARANTES DE LOS DERECHOS DE LOS PUEBLOS INDIGENAS; COMO ASI TAMBIEN DE LOS ORGANISMOS DE DDH Y MEDIOS DE COMUNICACI\u00d3N ANTE UN LATENTE NUEVO HECHO DE\u00a0 VIOLACION DE DDHH Y TRATADOS INTERNACIONALES EN COMUNIDAD INDIGENA LAS CAPILLAS DEL PUEBLO OKLOYA EN LA PROVINCIA DE JUJUY.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Mientras se desarrolla el Tinku (encuentro cultural) comunicaron el desalojo de la comunidad \u201cLas Capillas\u201d del pueblo Okloya.
